What qualifies me for SSD Benefits?

Often, people wonder whether they qualify for SSD benefits. It can be difficult to prove that you should be given these benefits, so it is important that you have significant documentation from your doctor that can support your claim. While no SSD claim is guaranteed, some of those that are accepted involve an individual who has a severe impairment or a combination of serious health conditions that limit his or her ability to perform at work. Additionally, the disability will likely need to fall on the list of impairments that were outlined by the Social Security Administration. These include, but are not limited to:

  • Arthritis and joint damage
  • Back injuries
  • Diabetes
  • Congestive heart failure
  • Asthma
  • Complex regional pain syndrome
  • Depression
  • Anxiety
  • Psychosis
  • Schizophrenia
  • Paranoia
  • Delusions
  • Hearing impairments
  • Stroke

What should I know if my SSD claim is denied?

If your SSD application has been denied, you have the right to appeal the decision as long as you do so within 60 days of the time you received your denial letter. With the help of an experienced legal team, you can work to fight this decision and get the benefits you need. The appeals process can be very complicated and requires a lot of documentation so it is critical that you do not attempt this alone. The four levels of the appeal process include:

  • Reconsideration, in which a third party who did not take part in the initial decision will assess the application and review both original and new evidence brought forth in the appeal.
  • A hearing with an administrative judge, where you may provide further information about your health condition and bring medical experts in to support your claim.
  • A review by the Appeals Court may be necessary if the administrative judge denied your claim.
  • A review by the Federal Court is the final option if the Appeals Council denies your claim in the previous step. The Federal Court will make the final decision regarding your claim, so it is essential that you have strong legal representation if your case gets to this point.
